4 Women File Suit Against NY DSF State Law..

A group of four women filed a lawsuit against New York State Governor Andrew Cuomo and the New York State Gaming Commission with the New York State Supreme Court on Wednesday.
The suit alleges that the law enacted by New York state in August regarding daily fantasy sports (DFS) violates the state constitution.
They contend that a constitutional amendment was required to permit DFS operators to host their games in NY state.

“The state constitution specifically gives the legislature the power to define what is – and what is not – gambling, and the legislature has done so a number of times in the past and long before the emergence of fantasy sports.
The Attorney General, who certainly has had some strong opinions about fantasy sports, has clearly stated he will enforce and defend this new law. This is a layup – they have no case.”

In addition, the DFS industry, which helped craft the bill with NY state legislators Sen. John Bonacic and Rep. Gary Pretlow, believe that it is within the scope of the legislature to decide what is defined as gambling.

DraftKings and FanDuel began operating in New York again after the bill was passed.
The DFS industry was barred from doing business in New York for several months earlier this year after Attorney General Eric Schneiderman issued cease and desist orders to the two companies.
At the time he argued that the DFS operators were in violation of gambling laws in the state.
